Who has to comply with the new laws?

In 2021, S1147/A1372 was signed into New Jersey law, requiring lead paint inspection on certain residential rental properties, including upon tenant turnovers.

Under this law, pre-1978 residential buildings are required to undergo lead inspection and risk assessment before being sold or leased. Landlords must also disclose any information about lead in the dwelling to tenants. Failure to comply with these requirements can result in penalties and fines. If lead is detected, landlords must take steps to reduce the lead hazards, such as implementing lead hazard reduction measures or providing interim controls.

The process of testing for lead in a home or building typically involves the following steps:

  1. Paint Testing: Synertech performs non-destructive paint testing using a portable X-Ray Fluorescence (XRF) Spectrum Analyzer. An XRF spectrum analyzer is a portable instrument that a lead inspector can carry to the job site for paint testing. The XRF is calibrated prior to and at the completion of every inspection to ensure the unit provides accurate readings of lead content of paints and other materials. 

  2. Laboratory Analysis: Samples of paint chips, settled surface dust, soil, water, or other materials can be collected and sent to a laboratory for testing. Samples are analyzed via Atomic Absorption Spectroscopy (AAS) or Inductively Coupled Plasma Mass Spectrometry (ICP-MS). The samples are analyzed in a laboratory to determine the presence and concentration of lead.

  3. Result Interpretation: The laboratory results are interpreted to determine if the levels of lead are above the action level set by the relevant regulatory agencies.

  4. Report Preparation: A report detailing the results of the lead test is prepared and provided to the building/property owner or occupant.

It is important to note that lead testing is required to be conducted by a New Jersey licensed lead inspector or risk assessor and a New Jersey licensed lead evaluation contractor such as Synertech. Only professionals trained in lead sampling and analysis should collect and interpret lead test results. Additionally, lead test results should be used to inform decisions about the elimination of lead hazards.
